1. Introduction — Who are we and what is this agreement?
GreenEdge B.V. (referred to as “Green Edge” and “we”) is a Dutch organisation based in the Netherlands. At Green Edge, we are committed to being transparent about how we collect and use your personal data and to protect the privacy of all users.
When you use any of the Green Edge cloud services or visit the Green Edge websites, we collect information (personal data) about you (e.g. via forms) to provide our products and services, in a fair and lawful manner. This means that Green Edge will collect and process personal data in accordance with applicable laws. This privacy statement is intended to inform you about the way we process your personal data.
This privacy statement may be modified from time to time. Please check this page regularly for any changes.
2. Purposes — Why are we processing your personal data?
We process your personal data in order to provide you with the services you request. This includes (but isn’t limited to):
- Delivering you our services
- Ensuring the security of our services
- Helping your out with your support requests
- Communicating with you about updates of our products
- Sending you invoices
- Improving the user experience of our products
Our processing activities rely on a number of legal grounds. We use your data to facilitate our business relations, pursue our legitimate business interests, and to comply with our financial regulatory and other legal obligations.
3. Your data — What information about you do we process?
Green Edge collects and processes personal data that you provide directly through forms on our websites and applications. The personal data that you provide directly to us will be apparent from the context in which you provide the data. This may include:
- Contact details (such as name, address, email address, phone number)
- Business details (such as business name, VAT ID, business registration ID)
- Any additional data that you provide (such as attachments or comments)
Green Edge also collects and processes personal data that is automatically collected through our websites and applications. This may include:
- Device data (such as IP address, browser, device type)
- Usage data (such as time spent on our website, which of our services you use, what software you run using our services, login times & sessions, compute capacity used)
- Billing data (such as invoices)
4. Disclosure — How do we go about sharing information with others?
Green Edge may share certain data about you with a supplier or contractor organization supplying services which require the use and/or creation of your data for the purposes described in this privacy statement and in accordance with applicable laws. In these limited situations, selected third parties may access your data. Before sharing any information with any third party, we will ensure that all third party recipients are bound to strict standards of compliance.
Green Edge does not sell or trade your data to any third party. However, we may be obliged to share certain data with third parties, such as government authorities, in accordance with applicable laws. It may also be necessary for Green Edge to share your data so as to protect the legal rights of Green Edge, again in accordance with applicable laws.
5. Retention — How long will Green Edge store your data?
Green Edge will retain your data for as long as you have a Green Edge account. After closing your account, or if you don’t have a Green Edge account, Green Edge will only retain your personal data if there is legal obligation to do so (e.g. financial records). Green Edge may also retain your data if there is a ‘business need’ to keep the your data (e.g. audit logs to ensure security). Without prejudice to local legislation, your data will be kept for a maximum of 3 years (i.e. 1095 days). This means that storage periods in local legislation are taken into account and complied with.
To ensure your data is kept safe Green Edge keeps regular backups of our data. These may include your personal data. Because it is impossible for us to remove selections of data from backups your data may remain in these backups after the retention period has expired. However, backups are removed after at most 3 months and data from them is only ever restored in emergency situations (e.g. Marvin accidentally deleting our production database during spring cleaning). If your deleted personal data is ever restored as part of a backup we will strive to delete that data.
6. Security — How do we protect your data?
Green Edge uses a number of technical, physical and organizational security measures to assure the integrity, confidentiality and availability of your data. Green Edge has implemented security technologies and procedures to protect the data we store about you from unauthorized access, improper use, alteration, unlawful or accidental destruction and accidental loss. We continue to improve our security procedures as new technology becomes available. Access to your data is limited. Green Edge data processors and employees only have access to the data needed to fulfill their responsibilities and are obliged to respect your privacy and handle your data with care. Green Edge ensures adequate security to protect manual and electronic processing of your data and prevent its misuse, all in accordance with applicable local legal requirements. Green Edge also ensures that third parties and affiliates processing your data on Green Edge’s behalf, will observe similarly adequate security measures again in accordance with applicable local legal requirements.
You have an important role to play in assisting Green Edge in keeping your data secure. You should use a unique password for Green Edge, keep it confidential at all times, and only use your Green Edge credentials on Green Edge services.
7. Your rights
You have the right to access the data that Green Edge holds regarding you. You have the right to request Green Edge to correct your data. Correction also implies supplementing, deletion, blocking or ensuring in another way that your data will no longer be processed. Green Edge only has an obligation to correct your data when the data is factually inaccurate, incomplete or irrelevant to the purpose for which Green Edge processes the data.
You can contact us to exercise your access and correction rights. Green Edge will process your requests and rectify errors in a timely manner.
